On December 21, 2020, Congress passed the Consolidated Appropriations Act, 2021 (Act), which has since been signed by the President. Under the terms of the Act, individual taxpayers receive a second round of stimulus funds. The majority of these funds were electronically deposited into the customer’s account. As the effects of the COVID-19 pandemic continue to drive the U.S. economy, chapter 7 and 13 bankruptcy filings are bound to accrue across the nation’s courtrooms. While 2020 experienced an all-time low for bankruptcy filings (the lowest number since 1985), this trend will likely take a drastic turn as government relief expires, and individual consumers and businesses can no longer delay.

The Supreme Court of Ohio delivered some good news to commercial creditors that utilize cognovits promissory notes to help secure performance of repayment obligations. In Sutton Bank v. Progressive Polymers, LLC et al., 2020 Ohio 5101, the court reversed a decision from the Eleventh District Court of Appeals and held that a cognovits note provision was not defective when the creditor used the required statutory warning language which displayed the clear intent of the parties.
